These Terms of Service ("Terms") govern your use of the Confident AI platform and website at confident-ai.us, operated by Confident AI ("we," "us," or "our"). By accessing or using our services, you agree to these Terms.
Confident AI grants you a limited, non-exclusive, non-transferable license to access and use the platform in accordance with these Terms and your subscription plan.

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated in these Terms or required by law. We reserve the right to change pricing with 30 days' notice.
If you exceed the evaluation limits on your plan, we will notify you and may temporarily pause evaluations until you upgrade or the billing period resets.
You retain all rights to your evaluation data, test cases, and model outputs. We process this data solely to provide the service. You may export or delete your data at any time through the platform or by contacting support.
The Confident AI platform, including its design, code, and documentation, is protected by intellectual property laws. Nothing in these Terms transfers any ownership of our intellectual property to you.
To the maximum extent permitted by law, Confident AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability for any claim arising from these Terms shall not exceed the fees you paid in the 12 months preceding the claim.
The service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be error-free or uninterrupted. Evaluation results are informational and do not guarantee the behavior of your AI models in all circumstances.
Either party may terminate the service relationship at any time. We may suspend or terminate your access immediately if you breach these Terms. Upon termination, your right to use the service ceases, and we will delete your data in accordance with our data retention policy.
These Terms are governed by the laws of the State of California, without regard to conflict of law provisions. Any disputes shall be resolved in the courts located in San Francisco, California.
We may update these Terms from time to time. We will notify you of material changes at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
